A foreign reparation obligor who has paid or incurred the obligation to pay benefits to a surviving spouse and next of kin of a person killed in a Minnesota automobile accident may not maintain an equitable subrogation action against a negligent third party to recover such payments. 2. The rights of the surviving spouse and next of kin pursuant to Minn. Stat. ร§ 573.01, et seq. (1984) to recover damages sustained as a result of the death of the decedent are not assignable.
